RULES & REGULATIONS:
By participating in the Get Your Art On Photo Contest, the entrant agrees to the following:
Submissions to the Get Your Art On Photo Contest must be made by the original photographer owning any copyright and excludes “works-for-hire.” Only one photo may be submitted per entrant.
Photo submissions must be in a digital format (jpeg). Digital images should have a resolution of at least 300 dpi or higher. Digital submissions must be received online Photo entry is from April 1 – May 14 at midnight.
All photos must be submitted electronically with application and signed release. Electronic signature and scanned copies are acceptable.
Submissions may not be watermarked or copyrighted.
By submitting a photograph, the participant releases the image to the Greater Des Moines Partnership (Partnership) and the Des Moines Arts Festival (DMAF) for non-exclusive rights to publish and use in promoting the Greater Des Moines area in future publications and other media. In exchange, the Partnership and the Des Moines Arts Festival agree to provide photo credit where possible when the image is used in promotions. This includes copyrighted works by the photographer.
Content of the photo submitted is at the discretion of the photographer. Contest organizers reserve the right to exclude from competition a photograph that may be considered pornographic or otherwise distasteful.
Furthermore, the Greater Des Moines Partnership and the Des Moines Arts Festival reserves the right to not accept or promote any photograph for any reason they deem valid.
The photographer must certify that he/she has obtained all required permissions regarding the subject matter and/or images presented in the photograph.
Affidavit of Eligibility. The undersigned (“Winner”) hereby certifies on his or her own behalf, and on behalf of his or her heirs, legal representatives and assigns, that Winner is a legal U.S. resident, 18 years of age or older, and is fully authorized to execute this Affidavit and Release. Winner hereby further certifies that he or she has read the Official Rules regarding the “Get Your Art On Photo Contest” and the related prize drawing, agrees to the terms and conditions therein, and confirms his or her compliance therewith. Capitalized terms not defined in this Affidavit shall have the meaning ascribed in the Official Rules. Winner agrees to return to Sponsor any prize that may be awarded to him or her if any statement made in this Affidavit is false.
Release of Liability. By accepting the prize, Winner releases and holds harmlessthe Sponsor, its affiliates, employees, officers, managers, directors, representatives, legal advisors, and agents from and against any and all losses, damages, rights, claims and actions of any kind whatsoever, directly or indirectly related to the “Get Your Art On Photo Contest” or arising from the acceptance, possession or use of the prize, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
Publicity. Winner understands and agrees that the Sponsor has the right and permission where lawful to use Winner’s name, likeness and/or voice in any media for trade, advertising, promotional and/or any other purposes without any further consideration. Notwithstanding the preceding, Winnerunderstands and agrees that the Sponsor is not required to use Winner’s name, likeness or voice in any way.
Costs and Taxes. The Organizer will not be responsible for costs incurred by Winner other than those specifically included in the prize. All federal, state and/or local taxes are the sole responsibility of Winner. Winner should consult his or her tax advisor regarding the reporting of prize value as income.
